How to Remove Hypothecation from Your RC After Paying Off a Car or Bike Loan

Paid off your vehicle loan? The bank's name still stays on your Registration Certificate until you formally get it removed through the RTO. This process is called hypothecation termination, and it requires Form 35 and a No Objection Certificate from your bank. Until you complete it, you cannot sell, transfer, or move the vehicle to another state.

Why You Must Remove It

Hypothecation means the bank has a legal interest in your vehicle as long as the loan is active. Even after you clear the last EMI, the bank's name remains on your RC until you formally terminate it at the RTO. Leaving it there causes real problems:

Cannot sell the vehicle

No buyer will accept a vehicle with an active hypothecation on the RC. The ownership transfer process at the RTO will be blocked until the bank's name is removed.

Cannot transfer to another state

The RTO will not issue a No Objection Certificate (NOC) for inter-state transfer if hypothecation is still active on the RC.

Insurance claim complications

In case of a total loss (accident or theft), the insurance payout goes to the bank, not to you, as long as the hypothecation exists on record.

Loan closure is not enough

The bank and the Vahan database are separate systems. Paying off the loan does not automatically update the RC. You must complete this process yourself.

Get NOC and Form 35 from Your Bank

Before you can approach the RTO, you need two documents from your bank. This is the first step and often the most time-consuming part of the process.

Bank NOC

A formal letter from the bank or NBFC confirming that your vehicle loan is fully repaid and the bank has no further claim on the vehicle. This is usually provided on the bank's letterhead with an official stamp and signature.

Form 35

The official RTO form for hypothecation termination. The bank must sign, stamp, and fill in their section (financier details, loan account number, closure date). You fill in the vehicle owner section. Get 2 copies signed.

Contact your bank's loan department after clearing the last EMI. Most banks issue the NOC and signed Form 35 within 7 to 21 days of loan closure. Some banks mail it to your registered address, while others require you to collect it from the branch. If the bank delays, escalate to their grievance cell.

Bank NOC expires in 90 days. Once the bank issues the NOC, you have approximately 90 days to complete the RTO process. If the NOC expires, you will need to request a fresh one from the bank, which may involve additional processing fees.

Documents Required

Gather all of the following before starting the application. The Vahan portal accepts JPG and PDF uploads (under 500 KB each).

Form 35 (signed and stamped by both you and the bank, 2 copies)
Original No Objection Certificate from the bank
Loan closure letter from the bank
Original Registration Certificate (RC)
Valid vehicle insurance certificate
Valid PUC (Pollution Under Control) certificate
Proof of identity (Aadhaar, PAN, or passport)
Proof of address (Aadhaar, voter ID, or utility bill)

Also collect the loan closure letter. This is separate from the NOC. The loan closure letter confirms that the loan account is fully settled with zero outstanding balance. Some RTOs ask for it in addition to the NOC, so keep it handy.

How to Apply on the Vahan Portal

Most states now support online hypothecation termination through the Vahan portal. Some states process it fully online (faceless), while others require a short RTO visit for document verification after the online submission.

1

Go to the Vahan portal

Visit vahan.parivahan.gov.in and enter your vehicle registration number on the homepage. Click "Proceed".

2

Open Vehicle Related Services

Click on "Online Services" and then "Vehicle Related Services". Log in or register using your mobile number.

3

Select "Hypothecation Termination"

From the list of services, choose "Hypothecation Termination (HPT)". Validate your vehicle by entering the last 5 digits of the chassis number and verifying via OTP.

4

Enter bank and NOC details

Fill in the bank or financier name, loan account number, NOC issue date, and loan closure date. These must match the details on your physical NOC exactly.

5

Update insurance details

Enter your current vehicle insurance policy number and validity dates. This is mandatory for all Vahan RC service applications.

6

Upload documents

Upload scanned copies of Form 35 (signed by the bank), bank NOC, loan closure letter, insurance certificate, PUC, and identity proof. Files must be in JPG or PDF format.

7

Pay the fee and submit

Review the fee panel (typically ₹100 to ₹500 depending on the state) and pay via UPI, net banking, or card. Save the payment receipt and acknowledgement number.

Verify online after approval. Once the RTO approves the termination, the hypothecation is removed from the Vahan database immediately. You can verify this by checking your vehicle details on the Vahan portal. The updated smart card RC without the bank's name is dispatched via speed post within 15 to 30 days.

Common Mistakes to Avoid

These are the most frequent reasons applications get rejected or delayed. Avoid them to save yourself an extra trip to the RTO or bank.

Form 35 not signed by the bank

The bank must sign and stamp their section of Form 35. If only the owner has signed it, the RTO will reject the application. Go back to the bank and get their signature before submitting.

Details mismatch between RC and NOC

The vehicle registration number, chassis number, engine number, and owner name on the NOC and Form 35 must exactly match the RC. Even small discrepancies (extra initial, different spelling) can cause rejection.

Expired bank NOC

The bank NOC is typically valid for 90 days. If you delay the RTO submission beyond this, you will need a fresh NOC from the bank, which may involve additional fees and processing time.

Pending e-challans or lapsed insurance

The RTO will not process the application if there are unpaid traffic challans or if your vehicle insurance has expired. Clear all dues and renew insurance before applying.

Frequently Asked Questions

How much does it cost to remove hypothecation?
The RTO fee for hypothecation termination is typically ₹100 to ₹500 depending on the state and vehicle type. An additional smart card printing fee may apply. There are no hidden charges when you apply through the official Vahan portal.
Can I do this entirely online without visiting the RTO?
Some states offer fully online (faceless) processing where you upload documents and pay the fee online, and the updated RC is mailed to you. Other states require a short RTO visit for physical document verification after the online submission. The portal will inform you which process applies to your state.
What if my bank is not giving me the NOC?
Banks are required to issue the NOC within 21 days of loan closure. If they delay, file a written complaint with the bank's grievance cell. You can also escalate to the Banking Ombudsman through the RBI's complaint portal if the bank does not respond.
Can I sell my vehicle without removing hypothecation?
No. The RTO will not process an ownership transfer (Form 29/30) if hypothecation is active on the RC. You must complete the termination first, get the updated RC, and then proceed with the sale.
I paid off my loan years ago but never removed hypothecation. Is it too late?
No, it is never too late. Contact your bank for the NOC and Form 35 even if the loan was closed years ago. Banks are obligated to issue these regardless of how much time has passed since closure. The RTO process remains the same.
